RIM gets kicked while down, sued over BBM trademark (update: RIM comments)

RIM has been a long December, and no reason to believe that this year will be better than the last. This month, the company was sued by the use of the brand and BBX was forced to change its name to 10 BlackBerry and all hit the fan when co-CEO Mike Lazaridis has given notice that phones that use the operating system is not mentioned until the end of 2012. And not even start working on the report on quarterly results. Unfortunately, that's not all: BBM Canada, a group of broadcast industry in Toronto has used the nickname of BBM in one form or another for six decades, wants his name - is used and popularized by the RIM BlackBerry Messenger Service - and filed a complaint against the phone manufacturer for trademark infringement. BBM Canada CEO Jim MacLeod says he has made several attempts to resolve the issue with them in the hope of avoiding the cut - even to the point of offering re-branding

: in February 2010, RIM has attempted to apply BBM for the brand with the Property Office intellectual in Canada, he said he was not recordable, and always went ahead and used it to your BlackBerry Messenger service anyway. Let's see what kind of explanation of the company to go forward and use three-letter acronym in a couple of weeks since the hearing was scheduled for January 11.

Update:
RIM we just sent an email with an official statement on the matter: source Since its launch in July 2005, the BlackBerry Messenger service has become a very popular social network. In 2010, RIM has begun to formally adopt the BBM stands, which at the time, was invented and widely used by the client BlackBerry Messenger natural organic as an abbreviation of the name of BlackBerry Messenger. The services associated with the BBM RIM provides clear they do not overlap with the services of BBM Canada and the two brands, so the right to co-exist under Canadian trademark law. Both companies are in different industries and have never been competitors in any field. We believe that BBM Canada is seeking trademark protection of BBM acronym that is beyond the narrow range of services offered and beyond the scope of their rights under trademark law in Canada. RIM has asked the Court to reject the application and award costs to RIM. In addition, for clarity, the trade mark application with RIM BBM Office of Intellectual Property in Canada (CIPO) is pending and we are sure that the record of the weather dictates. The deduction for CIPO BBM Canada rejected the request of the BBM RIM brand is very misleading.
