Once Again Apple Uses Image It Didn't License: This Time Photographer Sues

Lawyers for large companies tend to be notoriously prudent to ensure that companies licensed graphics they use for commercial purposes, for obvious reasons. And yet ... Apple seems to keep unauthorized use of images. It's really amazing. A few years ago, I wrote about how the default wallpaper for the iPad has been used without his approval. In this case, the photographer, Richard Misrach, was excited and said he was sure that the contract was on the way, and what was in it would be nice, "I'm sure I will send [the contract] now quickly ., but I'm very happy, I'm sure you're right and the conditions are good. "do not know if this experience makes Apple could do the same stuff, but the answer is not enough Misrach standard. And Apple is now discovering that they will face a continued Liewald photographer Sabine.

As stated on the website Patently Apple, Apple has continued Liewald alleging he used his photograph as part of a promotional campaign around the MacBook Pro on the screen of the retina.



The first link above, history MacObserver said that Apple uses a different (but similar) image of an eye. However, Apple said Liewald requested image from your web Liewald factory town, but only for the purpose of layout. Looks like someone then confused as to whether or not actually allowed the image. Again, this is not really surprising that Apple is much more attention to these things. Liewald apparently claiming that he is entitled to two "actual damages, including profits from the defendant"

statutory damages. It looks like a lawyer trying to push the company to respond more quickly - and would not be surprised if Apple cut a check Liewald decent fast enough to make this disappear. I can not imagine it's worth the fight against this lawsuit
