Australian Court: Google Must Pay Guy $200k Due To Image Search Turning Up Gangsters
not the case for Milorad Trkulga, formerly of Melbourne, Australia, was awarded $ 200,000 from Google as the search engine also gives Tony evoked images of images Mokbel, an apparent "Australian underworld figure."
The images were published after Mr. Trkulja was shot in the back by an unknown assailant while eating with her elderly mother in a restaurant in St Albans, in June 2004. When the name of Mr. Trkulja was written to search Google images, photos had appeared beside him Tony Mokbel gang figure.
From what I understood in the following link related Trkulja was actually shot while in a restaurant under a kind of gang warfare infamous which took place in 2004, when the bridge link to a gangster. When media publications wrote the story, including both images and Trkulja Mokbel, which probably makes his images appear together in the pursuit of its old name. Trukulja, for reasons that escape me, thought it was defamation and took Google to court. Google argued that it did not publish material that indexing search results. This apparently did not impress the jury.
However, the jury found for the defense of Google images has failed because it took no action to remove the pictures of their research once the lawyers Mr. Trkulja contacted the company. The jury decided that the search engine was responsible for search results, as Mr. Trkulja had not filled a form to report offensive material, by failing to include the URL of the content being opposed.
And this is where I'm confused of confusion, so maybe not an expert in Australian law there that can help in this case. The jury decided that Google simply obeys indexing Trkulja not matter if asked to take images from the search results, even if the jury finds that we are not responsible for the results and find that Trkulja not provide the actual URL you want to delete pictures. That would be me as a random person on the street, tapping his shoulder, telling them that I did not like what he said once, but could not remember exactly what it was that I offended, demanded an apology, then a deposit on a house free where the person did not random.
